To All Whom it may concern,
I, Mary Dare, widow of Hubbard Dare deceased, do hereby relinquish
my right to administer upon the estate of said deceased, and request that
John Downer be appointed to administer thereon. March 2nd, 1853.

On this day, before the County Court of said County, setting for
Probate purposes, personally came John R. Allen, who being duly sworn
according to law, declares that Hubbard Dare, late of said County, died
intestate on or about the 26th day of February, A. D., 1853.

Know all men by these presents that we, John Downer, Jesse Green.
Hezekiah McLaughlin and John N. Johnson of the County of Jefferson and
State of Illinois, are held and firmly bound unto the People of the
State of Illinois, in the penal sum of five thousand dollars, current
money of the United States, which payment well and truly to be made and
performed, we and each of us bind ourselves, our heirs, executors,
administrators and assigns, jointly, severally, and firmly, by these presents.
Witness our hands and seals this Seventh day of March AD 1853.
The condition of this obligation is such, that if the said John Downer
administrator of all and singular, the goods and chattels, rights and credits
of Hubbard Dare deceased, do make, or cause to be made, a true and perfect
inventory of all and singular the goods and chattels, rights and credits of
the said deceased, which shall come to the hands, possession or knowledge of
him the said John Downer as such administrator, or to the hands of any person
or persons for him; and the same so made, do exhibit or cause to be exhibited,
in the County Court of said County of Jefferson, agreeably to law, and such
goods and chattels, rights and credits, do well and truly administer, according
to law, and all the rest of the said goods and chattels, rights and credits
which shall be found remaining upon the account of the said administrator, the
same being first examined and allowed by the said Court, shall deliver and pay
unto such person or persons, respectively, as may be legally entitled thereto;
and further, do make a just and true account of all his actings and doings
therein, when thereunto required by said Court; and if it shall hereafter appear
that any last will and testament was made by the deceased, and the same be proved
in Court, and letters testamentary, or of administration be obtained thereon, and
the said John Downer do, in such case, on being required thereto, render and
deliver up the letters of administration granted to him as aforesaid, and shall,
in general, do and perform all other acts which may at any time be required of
him by law, then this obligation to be void, otherwise to remain in full force
and virtue.

The undersigned commissioners to set of[f] dower and make partition

That after being first duly sworn by Jonathan Wells an acting Justice
of the Peace in and for said County they proceeded by a personal examination

all of Jefferson County and State of Illinois, would respectfully represent and
show unto your Honor that Hubbard Dare late of Jefferson County State of Illinois
departed this life on or about the 27th day of February 1853 possessed as of fee
of the following lands situate lying and being in the said County of Jefferson
to wit: E ½ NE ¼, E ½ NW ¼, SW ¼ NE ¼ and NW NE ¼ all in Section 15. Also the
NW ¼ SE ¼, SE ¼ SW ¼, SW ¼ SE ¼ all in section “ “ and also lot No. 7 SW ¼ NE ¼
in section “ “ all in township 3S R2 East.
Your petitioners would further represent and show unto your Honor that
said Hubbard Dare left him surviving in addition to your petitioners, Mary Dare,
his widow, William C. Dare son of said Hubbard, Rowland Dare, son of said Hubbard,
Sytha Cole late Sytha Dare daughter of said Hubard and Henry H. Cole her husband,
and Sarah T. Dare daughter and sole heir of Moseday Dare deceased, son of said
Hubbard, who is a minor & for whom we pray that a guardian ad litem be appointed.
Your petitioners would further represent that they have been informed that
said Rowland Dare, said Henry H. Cole and said Sytha Cole, and one Jonathan Wells
have or pretend to have some kind of claim, right or title other than as heirs of
sd. Hubbard to a part of said land above described, but what right or title they
have if any or to what particular part thereof your petitioners know not. Your
petitioners would therefore pray that said Mary Dare, William C. Dare, Rowland Dare,
Henry H. Cole and Sytha Cole his wife, Sarah T. Dare, and Jonathan Wells be made
defendants to this bill, that a summons in chancery issue &c. and that said
Rowland Dare, Henry H. Cole, Sytha Cole and Jonathan Wells if they or either of
them have any title, claim or interest in or to any part of said land above described,
that they set it out and submit it to the judgment of this Hon’l. Court, and that
upon a final hearing hereof the dower of said Mary Dare be set off, and allotted
to her and that partition be made of all said lands for and by the judgment of
this Honorable Court to have belonged to said Hubbard Dare at the time of his
decease between his heirs aforesaid, provided said lands are formed susceptable
of division without material injury to said estate, but in the event they cannot
be so divided then that said lands be sold and the proceeds divided among the heirs
of said Dare aforesaid according to their several rights, and as said defendants
as well as said complainants are all equally interested in the partition of said
premises your petitioners pray that the costs of this proceeding including the
attorneys fee be equally divided.
And that all such other and further relief be granted your petitioners in
and about the premises as equity and good conscience may dictate, and your petitioners
as in duty bound well even pray &c.

said Bill or to so much thereof as he is advised by council is material for him
to answer unto answering says that he is the owner in fee of a part of the lands
in complainants bill, that he has the deed of said Hubbard Dare to the following
described premises to wit: all that tract of parcel of land known on the map of
the United States lands as part of the SE ¼ Sec 10 T 3S R 2E in the abstract of
lands subject to sale at Shawneetown, and bounded as follows to wit: Beginning at
the NE corner of the SE ¼ of the aforesaid section 10 and running from thence south,
and with the east line of said section “ “ poles to a stake on the aforesaid section
line, and from thence west and paralel with the north line of said quarter section
for enough to make or form a block of forty acres to a stake, and from thence north
to the north line of said quarter section and thence east with the north line of said
quarter section to the corner of same or place of beginning, containing forty acres
all of which will fully appear by reference to said deed herewith filed.
That he has no objection to the division of the lands in said bill mention
according to the prayer thereof and the respective rights of said parties.
And now having fully answered this respondent prays to be hence discharged

said bill as he is advised by counsel is material for him to answer answering
says that he has a regular claim of title by deeds duly executed from Hubbard
Dare to this respondent for a part of the lands described in said bill that is
to say beginning t the SE corner of the NE quarter of Sec. 15 T 3S R 2E running
thence north “” poles to a corner thence west “” poles to a stake thence south “”
poles to a stake thence east “”poles to the place of beginning containing “” acres
all of which will fully appear by reference to these several deeds of conveyance
herewith filed.
As to all the other obligations in complainants bill this respondent knows nothing
neither admits nor denies.
And now having fully answered respondent prays to be dismissed with his costs.

says, that he has a regular deed of conveyance from his father Hubbard Dare dec’d.
for a part of the premises described in the bill herein filed to wit: beginning at
a stake on the south line of the NE ¼ Sec. 15 T 3S R 2E, and “” poles west of the
SE corner of the same running thence north and with the W line of said E ¼ “ “ poles
to a stake thence E and paralel with the S line of said quarter section which is the
South line of this survey to a stake on the west line of Jonathan Wells, and which
“ “ poles west of the east line of said section 15 and thence south to the place of
beginning containing 70 acres & 20 poles, which said deed is dated on the 14th day
of Sept. 1849, all of which will fully appear by reference to said deed. Respondent
knows nothing of the other allegations in said bill.

Complainants beg leave of the court for amendment of the bill herein
would further represent that from the answers of Jonathan Wells, Rowland Dare
and Henry Cole herein filed and which complainants admit to be true that said
Hubbard Dare in his lifetime sold and conveyed by deed the following lot of land
to wit bounded as follows lot beginning at the SE corner of the NE ¼ of Sec. 15
T 3S R2E running thence to north “ “ poles to a corner thence west “ “ poles to
a stake thence south “ “ poles to a stake thence east “ “ poles to the place of
beginning containing “ “ acres and that said Jonathan Wells is now the owner
thereof, parcel of the land mentioned in said bill.
That during the life time of said Hubbard Dare he sold and conveyed by deed to
Rowling Dare the following lot of land parcel of the lands described in said bill
to wit beginning at a stake on the south line of the NE ¼ Sec 15 T3S R2E and “ “
poles west of the SE corner of the same running thence west to the south west corner
of the East ½ of the NW ¼ of sec 15 thence north and with the W line of said E ¼ “ “
poles to a stake thence east and paralel with the south line of quarter section which
is the south line of this survey to a stake on the west line of Jonathan Wells and
which is “ “ poles west of the west line of said Section 15, and thence south to the
place of beginning containing 70 acres and 20 poles.
That during the life of said Hubbard Dare he sold and conveyed by deed to said
Henry Cole the following lot of land bounded as follows to wit: beginning at the
north east corner of the south east quarter of Section 10 Township 3 South Range
Two East and running from thence south and with the east line of said section” “
poles to a stake on the aforesaid section line and from thence west and paralel
with the north line of said quarter section for enough to make or form a block of
40 acres to a stake, and from thence north to the north line of said quarter section,
and thence east with the north line of said quarter section to the corner of the same
or place of beginning containing 40 acres.
The following is a report of the value and number of acres of land belonging to
Hubbard Dare at his decease made by John Downer Administrator of the Estate of
Hubbard Dare deceased on the day of June A. D. 1853 to the Honorable Judge
John C. Saterfield.

six dollars and fifteen cts. And account against William Davis for two dollars
